The Annual meeting of 6.12.24

The meeting was held, with no quorum, and the elections were not held.

The Financial Statement was not ready and will be mailed in 2 weeks, as per Mr. Kalika.

It transpired that the person who claimed to be Mr. Kalika, the head of the Dependable Pro Management, at the last Annual meeting of March 22, 2023, (and with the false introduction by Grace Bishop), actually was not Mr. Kalika but one of his accountants, apparently chosen for this role for his deep voice and the imposing, authoritarian demeanor.

Now, hopefully, we deal with the real Mr. Kalika. He was again introduced by Grace Bishop, without any explanations of her mistake and this discrepancy, which proves once more that she is the blatant liar, bullshitter, and the psychopath.

I would like to remind everyone that impersonating the officer in his official capacity is illegal, and it is the criminal offense.

In plain English, they take you for idiots, guys!

The similar situation is with Al Rutigliano, Grace Bishop’s common law husband. He does not own any shares in this condo, nevertheless he was on the Condo Board. This is also illegal and the practice of Nepotism. According to the rules common for all Condos, the members of the same household are prohibited from serving on the same condo Board. The problem with Al was that he imagined himself a little Mafia Boss, and he tried to rule the roost, on behalf of his wife Grace, via his ENFORCER, super Ray, by instructing him to be rude and insulting to people, so he could insert himself as the middle man. Both of them were warned.

The atmosphere of lies and deceits pervades the whole behavior and the style, the modus operandi of Grace Bishop and the people around her, including the Dependable Pro and the Super, all of whom rob this Condo of the services it deserves, and MILK IT SHAMELESSLY for their own purposes and benefits, as it was described by me in the previous posts, and will be described again, in details, in the future.

And this continuous robbery results in the chronic state of disrepairs, with the ceilings falling on people’s heads at the regular intervals. The review of this subject as addressed in the previous posts, suggest that the main reason are the continuous leaks; in the winter from the heating system, and in the summer from the incorrectly installed air conditioners. And the reason for continuous leaks is that they are hidden inside the building structures, they are not watched for, and are not fixed in time. People do not want to deal with a super (“Ray”), who is arrogant, rude, and insulting  to people, demands the exorbitant tips, and with all that is incompetent, and does the shoddy work. People do not want to bother with him. The super and his family are more interested in free apartment than taking the adequate care of the building. The problem is not that they are the Muslim family, the problem is that their pattern of work fits with the very well known pattern and style of other supers of the Albanian or Balkanian descent. This is the primitive peasant mentality. They want to extract for themselves everything they can and more, seeing this building as their property, while working as little as possible. With this super and his work, this building will always have problems and will continue to be in the state of disrepairs. In my opinion, this super ABSOLUTELY has to be changed.  Some owners, in our private discussions, questioned the need for the free apartment as the part of the package. This issue has to be considered and discussed at the general meeting.

Some owners who are better familiar with the situation, told me that Super Ray has another, second job or that he works for his own business, has a big house upstate, and is in fact, a “millionaire”. Be it all as it may, it is clear that he is more interested in his free apartment and his tips than in honest work. Apparently, Grace Bishop is connected with him by some family ties, and this is the explanation of his super-favourable, special treatment. The kickbacks to the Dependable Pro from him are also quite possible, and even likely. It is also possible that this gang benefits financially from the illegal management of the short term rentals, the issue that is not addressed in the Bylaws but it is active and in the front of the current agenda.

The meeting was rather brief and we did not get to discuss this issue and the issue of Grace Bishop’ fitness to be elected, in the light of her crazy and brazen behavior and the attacks on others (see police report). These subjects should be discussed next time, hopefully.

My question at this meeting: “WHY DO CEILINGS FALL IN THIS BUILDING?” was left unanswered, and the meeting was closed in panic by Grace Bishop after I asked this question.

My opinion is that the group that calls itself the “Board” is completely fictitious and illegitimate. They have absolutely no proofs, including the documentation, to show what they claim. I think that this group of pretenders and imposters is detrimental to this building and to the financial interests of the unit  owners.

I think, that they also will carry the CRIMINAL RESPONSIBILITY if the falling ceilings kill or injure someone. We should not wait for it to happen.

We need the adequate Election, and the adequate, well functioning Board. Presently we do not have a Board, neither in the legal nor in the administrative sense.

The details and the Report on Financial Statement will follow later.

At mean time, I request from the current “Board” and  “Dependable Pro” the following information, which they have to give us by law.

  1. The most current Master List of Owners.
  2. Minutes of the last two annual meetings, of 2023 and 2024, and the lists of attendees for each of the meetings in 2023 and 2024, and the history of the previous meetings in chronological order for the last 35 years or during the total term  of service of Grace Bishop, whichever is longer.
  3. The list of the current “Board Members”, as they presented themselves at the meeting of 2024, and any other members, including the non-owners of the Condo shares.
  4. The plan for the Election of the New Board

I hope, that now, when the real Mr. Kalika was so happily and unexpectedly found, he will be able to deal with the issues and problems. I will summarize them briefly:

1. Change the super Ray ASAP!

2. Confirm the disqualification of Grace Bishop for election to the Board, according to the Bylaws.

3. Hold the general owners meetings monthly, if needed, and elect the new Board which will be able to function adequately. Also consider the electronic voting online and by mail. Make the voting process easier, not harder.

These problems will not disappear by themselves if you do not solve them.

We do have the instruments at our disposal to affect the needed changes. We should consider the NONPAYMENT of the common charges AS THE GROUP, to pressure the management Co. In this case, they will start singing a different song very fast. I urge Mr. Kalika to pay attention.

Mr. Kalika, his management Co, his Super, and his corrupt puppet “chairwoman” Bishop work at the pleasure of the shareholders, and these people can be fired at any moment without any particular reason or explanation, simply because their work is not seen as satisfactory by the shareholders.

And in my opinion, they should be fired and referred to the Criminal Prosecution for Negligence and other violations and offenses!
I intend to sue Grace Bishop for the attempted murder: that what spitting on another person in the times of COVID is.
I also intend to sue the Dependable Pro for fraud: impersonating the head of the company by another person with the purpose to mislead and to deceive the shareholders.

I plan to call the owners on the phone, to meet them personally, and to continue working on these issues. Have a good Summer!

It is the travesty and the perversion of the democratic process and the customs of this country. – 7:57 AM 7/5/2023 – Dear Mr. Aizin: I have to repeat one of the main questions: Who is on the Board? Where is the Board?  

“… big shiny GOLDEN letters all over the decaying shreds of the US Constitution, and especially its First Amendment: the matters “NEW” (e.g.: as in “New Board”, “New managing agent”, “New Board members”) and “OLD” (e.g.: as in “good OLD Russian mob” – 11:42 AM 7/3/2023 – Dear Mr. Aizin: All things “NEW” must be deleted! Or it will not be order in the Condo world!  – 

7:50 AM 7/3/2023 – To Mr. Aizin: Please also present the proves that such a claimed Board of Directors really exists … If such incontrovertible proves are not presented, it is logical to conclude that Ms. Bishop is not a member of the Board, and no such Board exists. And if Ms. Bishop is not the member of the Board, she has no right to spend the condo’s money on her personal legal issues … –

6:58 PM 7/3/2023 – Dear Mr. Aizin: Ms. Bishop was not and is not LEGALLY the member of the Board, according to Bylaws.

Dear Mr. Aizin:

The situation with Ms. Bishop’s liens 35 years ago is addressed in the sections of Bylaws quoted below. Section 2.7 says specifically and very clearly, that “no unit owner may be elected to serve … if the Board has perfected a lien … not paid at the time of the election”. 

The Section 2.9 (B) of the Bylaws states that lack of qualification described above in the Section 2.7 is equivalent to the automatic resignation of the Board membership “effective as of the date upon which such qualification shall cease.” It means that Ms. Bishop automatically resigned her Board membership at the time of her fraudulent election 34 years ago, and all these years she was not legally, by law the member of the Board, although she pretended to be. Conclusion: Ms. Bishop was not and is not LEGALLY the member of the Board, and she is not qualified for any future elections.   

Therefore any issues related to her claim of her Board membership are her personal legal issues, not the Board issues, and any and all legal expenses related to this question should paid by her personally, and not by the Condo Board. 

Your legal fees payment agreement with Ms. Bishop is illegal, it has no legal power, and you should not be paid for these services out of the Condo money. I feel that it is my obligation to alert other owners to these issues and to prevent the payment of Ms. Bishop’s personal legal bills under the guise of the Condo’s legal expenses.

Ms. Bishop hired a lawyer, Michael Aizin, to defend her in this conflict, but she pays these legal expenses from the Condo money, not her own. Last year she spent $7,000, and likely much more in hidden legal expenses. This is your money! If she wants to get engaged into legal battles, let her pay for it herself! You do not have to pay to defend the liar and the crook! We will start a petition which will prohibit her from spending the condo money on her personal legal defense. Join us!

There is a conflict and a dispute in the Condo of 2900 Ocean ave in Brooklyn, NY., of which I am an individual owner (5E).
The concerned group of owners shares the view that the presently claimed Board Prez, Grace Bishop is illegitimate, due to the facts that she concealed her past indebtedness to the Condo when first elected, and then she engineered the “no quorum” reappointments, conspiring with the property management company by not mailing out notices prior to the condo owners meetings. This company remained the same business entity under the different shingles in the past 34 years, which is the same time period as Ms. Bishop’s rule. 
Furthermore, our impression is that this person, Ms. Bishop acts in the manner of a crazy dictator and that she is not fit to discharge her duties, and that she is at the direct physical danger to those who dare to criticize her: she will come to your door, will bang on it very loudly with her walking cane and will try to attack you with it, as it happened recently with myself. We have to warn each other of these types of dangers. 

Now Ms. Bishop tries to put the legal blocks to the questioning of her authority: she sent me a “cease and desist demand” via her lawyer Michael Aisin. I am in the process of hiring a lawyer to address these moves. 

The legal interventions might bring the resolution to this conflict. It would be good to prove legally that she is unfit and disqualified, unable to discharge her duties, and needs to be removed, with the elections being called. 

However, at this time we will have to postpone the plans for the election until we are on the firm legal footing. 

Some answers with regard to the existence of the 2900 Ocean ave. Condo Board: 
Nobody knows who the Board members are, and if they exist at all. 
Nobody got the mailed notices about May 22 meeting, they were placed only in elevators. 
That was enough reason to assume that there is no Board.

I agree with everything said in your letter Mike! Just to add, there has not been a single annual meeting held at all from 2019, 2020, 2021. The notices for 2022 annual meetings were never mailed but posted about 3 or 4 days prior to in the elevator when most of the residents have already made arrangements for Memorial Day weekend resulting in only 18 people attending out of 89.

As Bishop concealed the fact that she had 2 liens placed on her property for the total of around $6000 by the Board and never disclosed that fact during the annual meeting in 2015 when she presented her candidacy to constituents to become a President (she was a Treasurer), her election was fraudulent.

Ms. Bishop:
I’ve read your response letter that you distributed on 6.14.23.
Let us save the emotions and arguments about what we are and what we are not for later discussions, which may be more fact based. For now, I ask you again to comply with the law and to release the following information: 

– Offering Plan, as per Mr. Blackman’s request in preparation for the referendum, and the Master List Of Condo owners. 

– The list of currently claimed Board Members, Treasurer, and managing agent. Is it still Randy Sulzer?
– Response to the situation with the falling ceilings.
– Address your recent grossly inadequate behavior and the opinion that you are prone to the uncontrollable attacks of rage, and therefore unfit to serve in any elected position which requires the adequate response and dealing with the criticism, be it fair or not.
– Answer directly if you are ready to submitt your resignation, what are your plans for the urgently needed election, and your response to the opinion that you are disqualified from all future elections. 

– With regard to the person who lives with you in your apartment, Mr. Alberto Rutigliano, there are no public records of your marriage, and he does not own any shares in this Condo, therefore he does not have any right to interfere in its affairs. Besides that, the generic Condo Law explicitly prohibits the representation of more than one person per household on the Condo Board and its governing structures. Otherwise, it is called NEPOTISM. Once again, I urge Mr. Rutigliano to stop acting as the middle man between you, shareholders, and the Super, whom he coerced into carrying out his orders and instructions. The Super and his family are not Al’s enforcers, and Al is not your enforcer. If you think otherwise, prove it in the Court of Law. 

I also would like to remind you that the Condo Election is the small scale POLITICAL process which uses the POLITICAL speech, protected by the First Amendment, as its tool. But it does not include the political or any other VIOLENCE which you allowed yourself to get engaged in. 

Why is Ms. Bishop getting so nervous? Because it is getting HOT(!) and close, and she does have something to hide, as always. 

I offer you to have a civilized pre-election discussion on the pages of these websites. If you submit your letter in Comments section, it will be published. I offered this to you earlier. It is much better than the wild actions and “confiscating” the other party’s pre-election materials. 

I also would like to inform you that I intend to continue my contacts with the Brooklyn DA office regarding these matters.

If she does not like you, she will come to your door, will start banging on it, and will try to beat you with a stick. 

Grace Bishop is sick, as her recent attack of rage confirmed. She has the appearance of a person who is afflicted with the quite specific Fetal Alcohol Syndrome, which is caused by the alcoholism in mothers. These persons have the specific changes in their personalities and behavior, and the rage attacks, which is the specific neuro-psychiatric condition, may be one of them. 

Ms. Bishop: I think that you are afflicted with the Attacks of Rage. This makes you potentially dangerous to others. You are not able to take the criticism appropriately and to deal with it adequately, which is a requirement for any elected position of responsibility, including the Condo Board. Therefore you are unfit to be the President of the Condo Board and you should submit your Resignation Letter. It is long overdue for other reasons also. 

If the Resignation Letter from you is not received within 3 days, the group of concerned shareholders of this Condo will request from the proper authorities the psychiatric expertise of you for the evaluation of the potential of dangers to others and the fitness for your claimed membership of the Condo Board. This evaluation should include your previous psychiatric and life histories, and the previous episodes of Rage Attacks.

I want to assure Ms. Bishop and every one that the change of Condo leadership and property managers is not a witch hunt against anybody. We do not need witch hunts and will not allow them. 

The criminal complaints that were launched have the moment of their own and are the subjects of the investigations of the proper authorities. 

We just want the life and the functioning in this Condo to be normal and optimal. 

Ms. Bishop: You mentioned in your comments that the financial decisions are made not by you but by the majority of the Board and the Treasurer.

WHO ARE THESE PEOPLE? 

Why you do not disclose their names and identities? Give us their names. 

Why you do not release the documentation, even the most innocuous one, such as Offering Plan? 

I requested the Master List of owners and other information from you but did not get any response. 

This information has to be provided readily, according to Law. Why do you ignore the legitimate requests? 

Let me remind you: 

THIS IS NOT RUSSIA!!!

THE RUSSIAN AND RELATED MAFIAS  DO NOT AND WILL NOT RULE HERE!!! 

People are perfectly able to determine what is what and to distinguish the TRUTH from lies.

Hi Mike,
Do you remember Wentworth Management that managed the building around 2007 and on? Did you know that Wentworth Management and First Service Residential aka Cooper Square etc are all the same entities ?   FirstService Residential, FirstService that generates over US$2.2 BILLION in annual revenues (NASDAQ: FSRV, TSX: FSV,) operating in multiple states (including New York) aka Euclid Management aka Continental aka Starr Management aka Armstrong Management Services, Cooper Square aka Wentworth Management and many many more aliases or “subsidiaries “ that put hundreds of lives (including mine and yours and apt 4N and all other 89 units in our building) in imminent danger, ignoring foreseeable risks and refusing to assume any responsibility in their apparent effort to prioritize profit over people’s safety and further engaged in an an elaborate criminal actions (geared to silence any complainant) with an illegal scheme  and CORPORATE fraud using multiple NAMES, ALIASES and CORPORATIONS.
FirstService searches for buildings with  the construction defect in the building , does not maintain buildings, does not inspect, does not repair , evades all complaints , recruits “politicians”  on the board for a building to award legal, construction defect and other work for the associations to entities controlled by the FirstService and its co-conspirators while performing minimal work, evade all complaints, and sell the residential units affected to multiple shell corporations.

Champlain Towers South, a 12-story upscale condominium in Miami Surfside, Florida that has collapsed in 2021. Ninety- eight people died.Conveniently, there were NO registered complaints to that effect.”  (See major news channels. Investigation is ongoing.

FirstService Residential is a property managing company for hundreds of building in New York, Florida and multiple other states in the USA using multiple aliases/“subsidiaries “such as Euclid Management aka Continental aka Armstrong Management Services aka Wentworth Management aka Cooper Square aka CitiLine Management and many many more aliases or “subsidiaries “ that they are hiding under to diffuse responsibility for their actions.
  1. First Service Residential (“FSR” or “FirstService”) has been investigated for fraud, kickbacks and corruption.
  2. First Service Residential license was suspended for 60 days as a result of a consent order in Virginia. (Attached exhibit )
  3. First Service Residential is a complete fraud rotating their managers every year from building to building to diffuse responsibility. I made multiple requests to address my complaints which were not addressed by a “new” manager. 
  4. Equally First Service Residential started using its “subsidiaries”/ “aliases”, Dependable Property Management (www.dependablepro.com) to process invoices, a shell corporation registered in NY in 2004 that stopped filing biennial statements from 2010 and had been in past due status with the Department of Corporations for close to 12 (twelve) YEARS until they were faced with the New York State Division of Licensing  Investigation with their mandatory response under Article 12-A §442-e (5). (Exhibits A, H,).
  5. Domestic and foreign business corporations are required by Section 408 of the Business Corporation Law to file a Biennial Statement every two years with the New York Department of State. The second to last biennial statement that has been filed by Dependable Property Management was in 2008 (see attached exhibit H,) and finally filed again in September 2022 , after  12 (twelve) YEARS of non compliance.
  6. Notably, the Chief operating Officer for “Dependable Property Management “, is Alexander Karasik, an  attorney whose practice involves personal injury and “Corporate & Business”. Mr. Karasik is certainly well versed on all aspects of mandatory compliance of filing biennial statements but chose non compliance for close to 12 (twelve) years. (See attached exhibits 
First Service searches for buildings with defects and recruit “politicians “ who vote to award legal, construction defect and other work for the associations to entities controlled by the FirstService and its co-conspirators. In my case, by registering Randy Sulzer as an Officer for The Board of Managers of 2900 Ocean Condominium (“The Board”) and a managing agent, First Service Residential was allowed to choose and maintain insurance coverage for the building and its employees for which they received or participated in commissions and/or fees arising out of any insurance placed on the building or services performed to be paid to agent by any carrier or paid to owner’s insurance broker by any carrier.
The Department’s Building Information Summary Report lists Randy Sulzer ,as an Officer for 2900 Ocean Condominium, and the Managing Agent for the building (along with First Service Residential). Randy Sulzer assumed a dual role as an Officer for the Board and the managing agent -in an apparent conflict of interests. (Exhibit B, E)
Presidential Elections:
Despite of the fact that the presidential elections should be held annually, Bishop conspired with FSR / “Dependable Management” to intentionally refrain from holding the annual elections. 
They refused to hold a single annual meeting from 2019 . After multiple tenants (including myself) extensively questioned their fraudulent practices for years , without providing any advance notice, they posted an annual meeting notice 4 days before the meeting in the elevator, laundry room and a back corridor scheduling the said annual meeting for 05/22/23 few days before most residents have already made plans for their Memorial Day vacations.
As a result of their collaborate and fraudulent attempts to properly post advance notices, only 18 people (out of 89)  attended the meeting . This is all done on purpose with an agenda to continue their rogue operations unrepremanded.
